1. Acceptance of These Terms

By downloading, installing, creating an account for, purchasing through or using the Service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service. If you use the Service for an organisation, you represent that you have authority to bind that organisation.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of legal majority where you live, a parent or legal guardian must review and approve your use and any purchase. You must be legally capable of entering these Terms and must not be prohibited from using the Service under applicable law.

3. Flight-Simulation Service Only

It must never be used to control, navigate or operate a real aircraft or to make a real-world safety decision. Always follow the rules of the simulator platform and, in real aviation, official regulations, approved information and qualified aviation personnel.

4. Accounts

An account is optional for the core offline simulation but may be required for trials, Premium entitlements, restoration, cloud settings or other online features.

You agree to provide accurate account information, keep your credentials confidential and promptly notify us of suspected unauthorised access. You are responsible for activity performed through your account except to the extent caused by our failure to use reasonable security.

You may request deletion using the process described on the Account Deletion page. A direct in-app deletion control is being prepared for the public Google Play release. Account deletion is separate from subscription cancellation.

5. Speech, Audio and Generated Output

Speech recognition, language normalisation, generated speech and simulated controller responses may be inaccurate, delayed, incomplete or unexpected. You remain responsible for checking the simulation state and output.

Selecting microphone, overlay, phone-recognition, offline-recognition, cloud text-to-speech or LAN features authorises the processing reasonably required to provide the selected feature as explained in the Privacy Policy.

We do not claim ownership of an ordinary transmission that you speak into the Service. You must not submit content that violates another person's privacy, intellectual-property rights or applicable law.

6. Beta and Pre-Release Builds

When you participate in a beta or other pre-release programme, you understand that:

• The build may contain defects, unfinished features, performance problems or compatibility issues.
• Features, accounts, settings, trial records and other test data may be changed or reset.
• Beta access or promotional Premium access may expire at the end of the programme.
• You may need to uninstall a beta build and install a later Google Play build.
• You should not rely on a beta build for critical or irreplaceable information.
• You may submit feedback voluntarily, but you should remove passwords and unnecessary personal information from logs or media first.

Unless we expressly state otherwise, beta participation does not promise future free access, compensation, employment, ownership or a particular release date.

7. Free Features, Trials and Promotions

Available free and Premium features may be shown inside the application before purchase. A one-time 24-hour Premium trial, when offered, is timed by the server, does not require payment and does not automatically convert into a paid subscription.

Attempts to create multiple accounts or manipulate device time, app data or entitlement records to repeat a one-time offer are prohibited.

Promotional or beta Premium access may have its own eligibility period and may end automatically. A promotion does not create a permanent entitlement unless we expressly say so in writing.

8. Google Play Subscriptions

Android subscriptions purchased in the app are processed by Google Play. The product page and purchase screen will display the applicable price, billing period and material offer terms before you confirm payment.

A subscription automatically renews for successive periods unless you cancel it through Google Play before the renewal date, subject to Google Play's terms and applicable law.

• Uninstalling the application does not cancel a subscription.
• Deleting a Universal ATC account does not automatically cancel a Google Play subscription.
• You can manage or cancel a subscription through Google Play Subscriptions.
• Cancellation normally stops future renewal; access generally continues until the end of the paid period.
• Refunds are handled under Google Play's rules and any mandatory consumer rights that apply.
• An internet connection and signed-in Universal ATC account may be required to verify, restore or transfer an entitlement.

If website purchases are later offered through Paystack, the checkout page will display the separate price, duration, renewal and cancellation terms before payment. Website billing will not be represented as Google Play billing.

9. Changes to Features and Prices

We may improve, replace, limit or discontinue features as the Service develops. We may change prices for future billing periods with the notice and consent required by Google Play and applicable law.

Changes do not remove non-waivable consumer remedies. If a paid feature is materially discontinued, any refund or continuation rights will be determined by applicable law, the purchase platform's rules and the specific offer.

10. Offline Resources and Device Requirements

Offline speech and voice features may require large model or voice-pack downloads, compatible hardware, sufficient storage and one-time online setup.

Performance varies by device. Downloading resources may use significant data and may incur network charges from your provider. We do not guarantee that every resource, language, device, operating-system version or third-party flight simulator will remain compatible.

11. Acceptable Use

You must not:

• Use the Service for real-world aircraft operation, emergencies or unlawful activity.
• Attempt to bypass subscription, trial, licensing, authentication or security controls.
• Reverse engineer, decompile or extract protected Service components except where applicable law expressly permits it.
• Redistribute, sell, sublicense or republish application models, voice packs or other bundled/downloaded resources without written permission.
• Use a voice pack or generated audio to impersonate, deceive, harass or violate another person's rights.
• Interfere with servers, downloads, accounts or another user's access.
• Upload malware or attempt to obtain credentials, tokens or data without authorisation.
• Use automated means to abuse account, trial, payment, support or feedback systems.

12. Ownership and Licence

Universal ATC and its licensors retain all rights in the Service, including software, user interface, text, graphics, models, voice packs, generated-system content, databases and branding, excluding content owned by users or third parties.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for private simulation and entertainment.

Third-party components and models remain subject to their respective licences. Nothing in these Terms grants permission to use a real person's name, likeness or voice outside the rights provided by the applicable licence or written consent.

13. Feedback

If you voluntarily provide suggestions, bug reports or other feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free licence to use, reproduce, adapt and incorporate that feedback to operate and improve the Service.

This licence does not transfer ownership of your unrelated personal content and remains subject to the Privacy Policy.

14. Third-Party Services and No Affiliation

The Service may interact with Google Play, Supabase, device speech services, hosting providers, download services, payment providers and third-party flight simulators.

Their services are governed by their own terms. Universal ATC is not endorsed by or affiliated with any airline, airport, air navigation service provider, aviation authority, aircraft manufacturer or flight-simulator publisher unless expressly stated.

15. Availability, Updates and Support

We aim to provide a reliable Service but do not guarantee uninterrupted, error-free or permanent availability.

Online features may be unavailable because of maintenance, provider outages, connectivity, security incidents or events outside our reasonable control.

Updates may be required for security, compatibility or billing. Support is provided on a reasonable-efforts basis and no guaranteed response time applies unless separately agreed in writing.

16. Suspension and Termination

You may stop using the Service at any time. We may suspend or terminate access when reasonably necessary to address serious or repeated violations, fraud, security threats, legal requirements or discontinuation of the Service.

Where practical and lawful, we will provide notice and an opportunity to resolve the issue. Termination does not automatically cancel a Google Play subscription; cancellation must be completed through Google Play.

17. Disclaimers

We do not warrant that speech recognition, translations, controller responses, weather, airports, procedures, voices, downloads or simulated clearances will be accurate, current, complete or suitable for a particular purpose.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

18. Limitation of Liability

To the fullest extent permitted by law, Universal ATC and its contributors will not be liable for indirect, incidental, special, consequential or punitive loss, loss of data, loss of profit or loss arising from prohibited real-world aviation use.

For any claim relating to the Service, our total aggregate liability will not exceed the greater of the amount you paid to Universal ATC for the Service during the twelve months before the event giving rise to the claim or the minimum amount required by applicable law.

These limits do not apply where liability cannot legally be limited, including for fraud or other non-excludable liability.

19. Indemnity

To the extent permitted by law, you agree to indemnify Universal ATC against third-party claims, losses and reasonable costs arising from your unlawful use, infringement of another person's rights or material breach of these Terms.

This section does not require indemnity for loss caused by our own unlawful conduct.

20. Privacy

Our Privacy Policy explains how personal information is handled.

It forms part of the rules governing your use of the Service. Where consent is legally required for optional processing, acceptance of these Terms is not a substitute for that consent.

21. Governing Law and Disputes

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law rules.

Before starting formal proceedings, please contact us and allow a reasonable opportunity to resolve the dispute informally.

Subject to any mandatory consumer right to use a different court or process, Nigerian courts will have jurisdiction. Nothing in this section limits a right to complain to a regulator or consumer-protection authority.

22. General Terms

If part of these Terms is unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver.

You may not transfer these Terms without our written consent; we may transfer them as part of a reorganisation, financing or transfer of the Service, subject to applicable law.

These Terms, the Privacy Policy and purchase terms shown at checkout constitute the entire agreement concerning the Service unless a separate written agreement applies.

23. Changes to These Terms

We may update these Terms to reflect Service, provider, legal or business changes.

We will revise the effective date and provide additional notice for material changes where appropriate. If law requires renewed agreement, we will request it.

Changes do not retroactively remove rights that have already accrued.
